These Terms of Service ("Terms") govern your access to and use of the website and services of Vermont Pure Foods dba Nature's Market ("Nature's Market," "we," "us," or "our"), including https://naturesmarketvt.com and any related pages, accounts, and features (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Who May Use the Services

You must be at least 18 years old to create an account or use the Services. Because some of our products include alcohol, certain features and any alcohol-related purchases or pickups require you to be 21 years of age or older, and you may be required to confirm your age and present valid government-issued identification. You are responsible for ensuring that your use of the Services complies with all laws that apply to you.

2. Your Account

When you create an account, you agree to provide accurate, current, and complete information and to keep it up to date. 3. Wine Club, Events, and Promotions

From time to time we offer a wine club, events, loyalty rewards, and promotions. Participation may be subject to additional rules, eligibility requirements, capacity limits, and pricing that we will make available at the time. Event reservations, tickets, and wine club memberships may be subject to their own payment, cancellation, and refund terms. We reserve the right to modify, suspend, or discontinue any program, event, or promotion at any time.

4. Communications and Consent

By providing your email address or phone number and opting in, you consent to receive transactional and marketing communications from us. You can unsubscribe from marketing emails at any time using the unsubscribe link in those emails. For text messages, message and data rates may apply, message frequency varies, and you can opt out at any time by replying STOP, or reply HELP for help. Consent to receive marketing messages is not a condition of any purchase.

Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of the amount you paid us, if any, in the twelve months preceding the claim, or one hundred U.S. dollars ($100).

You agree to indemnify and hold harmless Nature's Market and its owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if you violate these Terms. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by the laws of the State of Vermont, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Vermont, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
